It’s official. CBS will not be fined $550,000 for [lastfm link_type="artist_info"]Janet Jackson[/lastfm]‘s 2004 wardrobe malfunction during her performance at the Super Bowl XXXVIII broadcast. An appeals court ruled that CBS was not to blame for the airing of the malfunction.
According to the appeals court, the FCC’s decision was made “arbitrarily and capriciously.”
The court’s ruling comes several years after conflicting decisions and confusion.
The performers during the 2012 Super Bowl will be [lastfm link_type="artist_info"]Madonna[/lastfm], who will headline the half-time show, alongside [lastfm link_type="artist_info"]M.I.A.[/lastfm] and [lastfm link_type="artist_info"]Nicki Minaj[/lastfm]
